TERMS OF SALE AND USE

1. Seller

This website is operated by FRAGMENT, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered with the Paris Trade and Companies Register (RCS) under number 983 235 821, whose registered office is at 131 rue des Dames, 75017 Paris, France. 2. Scope

These terms apply to all sales made on this website and to the use of the website. By placing an order, you accept these terms. The version published on the website at the time of your order applies.

3. Use of the website

You must be of legal age in your country of residence to place an order, or have the permission of a parent or guardian. The website and its content may not be used for any unlawful purpose. We may refuse access to our services or cancel an order in case of fraud, suspected fraud or misuse.

4. Products and prices

We take great care to describe and photograph our products as accurately as possible; small differences in colour or finish may remain. Prices are shown in the currency of your market and include VAT where applicable. Delivery costs are shown before payment. We may change our prices at any time; the price applied is the one shown when you place your order. In case of an obvious pricing error, we may cancel the order and refund you in full.

5. Orders and payment

Your order is confirmed by email. Payment is taken when you place your order, by the payment methods offered at checkout. Transactions are secured and encrypted by our payment providers.

6. Delivery

Delivery times and costs are set out in our shipping policy. The risk of loss or damage passes to you when you, or a person you have designated, take physical possession of the order.

7. Right of withdrawal

If you are a consumer, you have 14 days from the day you receive your order to withdraw from your purchase without giving any reason. We extend this period to 15 days. To withdraw, email us at contact@fragment-studio.fr with your order number. Return the items unworn, in their original packaging, within 14 days of telling us; the direct cost of returning them is paid by you. We refund all payments received for the returned items, including standard delivery costs if the whole order is returned, within 14 days of receiving them, using your original payment method unless you agree to store credit. You are responsible for any loss in value of the items resulting from handling beyond what is necessary to check their nature and characteristics. Exchanges and other return options are described in our refund policy.

8. Legal guarantees

If you are a consumer, you benefit from the legal guarantee of conformity for 2 years from delivery, and from the guarantee against hidden defects, under the applicable law. To use these guarantees, contact us with your order number and a description of the problem. Our commercial warranty (lifetime warranty against tarnishing, 60 days for manufacturing defects, 1 year for stones) is described in our refund policy and applies in addition to these legal guarantees.

9. Liability

We are not liable for indirect damage, or for damage caused by misuse of the products or by events beyond our reasonable control. Nothing in these terms limits your rights as a consumer under the applicable law.

10. Intellectual property

All content on this website (texts, images, logos, designs and graphics) belongs to FRAGMENT or its partners and is protected by intellectual property laws. Any reproduction without our written permission is prohibited.

11. Personal data

We process your personal data as described in our privacy policy.

12. Disputes and applicable law

These terms are governed by French law. In case of a dispute, please contact us first so that we can find a solution together. If you are a consumer, you keep the protection of the mandatory rules of your country of residence and may bring a claim before the competent courts.
